Present: Ms. Dean, Mr. Bloom, Ms. Brymer, Mr. Mulholland and Mr. English.  Alternates:  Mr. Belden and Mr. Cruson.  Also present: George Benson, Land Use Director.  Clerk:  Ms. Wilkin

PUBLIC HEARING (Continued)

APPLICATION BY MOUNT PLEASANT ROAD LLC FOR A SPECIAL EXCEPTION TO CONSTRUCT AN OFFICE BUILDING AT 174 MOUNT PLEASANT ROAD, NEWTOWN, CONNECTICUT, AS SHOWN ON A CERTAIN MAP ENTITLED “SITE DEVELOPMENT PLAN PREPARED FOR MT. PLEASANT ROAD, LLC, 184 MOUNT PLEASANT ROAD, NEWTOWN, CT” DATED FEBRUARY 5, 2007, LAST REVISED 1/8/08, SCALE 1”=40’, ASSESSOR’S MAP 2, BLOCK 5, LOT 6

The Police Commission will discuss this matter at their May 6, 2008 meeting.  The hearing was re-scheduled for May 15, 2008 when this Commission is in receipt of their report

APPICATION BY JONATHAN HAYDEN FOR A FOUR LOT RE-SUBDIVISION, 12 BOTSFORD HILL ROAD, NEWTOWN, CONNECTICUT, AS SHOWN ON A CERTAIN MAP ENTITLED “RESUBDIVISION LOT 3, MIRIAM E. HUGHES SUBDIVISION, PREPARED FOR JONATHAN F. HAYDEN, 12 BOTSFORD HILL ROAD, NEWTOWN, CONNECTICUT’ DATED JANUARY 28, 2008, SCALE 1” = 60’, ASSESSOR’S MAP 47, BLOCK 9. LOT 7 LT3

Larry Edwards P.E., 227 Stepney Road, Easton, Connecticut explained the changes suggested by the Commission, which were reflected in revised maps.  He agreed to move precarious rocks on top of a ridge and offered a 50 ft conservation easement on the western edge of the property.  

There were two memos from the town Engineer regarding cut and fill calculations and driveways dated April 11 and 14, 2008.  

Ms. Dean asked to hear from the public.

Randi Keily, 18 Botsford Hill Road, Newtown, Connecticut was concerned about boulders perched behind her house.

Fred Biondi, 7 Stewart Drive, Newtown, Connecticut asked about the location of the driveway that was close to the property line.  He was concerned about drainage.

Tony Mohigel, 6 Stewart Drive, Newtown, Connecticut expressed concern about blasting and the effect on his well.

Ms. Dean advised him to get a pre-blast survey.

The hearing was closed at 8:10 p.m.

ACTION

Ms Brymer moved the following:

BE IT RESOLVED by the Newtown Planning and Zoning Commission that the application by Jonathan Hayden for a four-lot re-subdivision, 12 Botsford Hill Road as shown on a certain map entitled “Resubdivision Lot 3, Miriam E. Hughes Subdivision,  Prepared for Jonathan F. Hayden, 12 Botsford Hill Road, Newtown, Connecticut” dated January 28, 2008, last revised April 14, 2008, scale 1”=60”, Assessor’s Map 47, Block 9, Lot 7 LT 3

SHALL BE APPROVED with the following stipulations:

1.      That prior to filing the record maps in the Newtown Land Records:
        
a.      A bond in the amount of $94,625 shall be submitted to secure the following subdivision improvements:

                        Common Driveway                 $52,000
                        Fire Suppression Tank           $40,000
                        Lot Pin Bond                            $  2,625

2.      That the applicant accept the fee-in-lieu of open space in the amount established by the Town’s appraiser, Kerin and Fazio LLC.

3.      That a 50 ft. Conservation Easement be placed on the record map along the entire western property line of the subdivision.

4.      That the applicant accept the Common Driveway Bond to be submitted by the Town Engineer

5.      That the applicant indicate the previously disturbed area on the record map, and that the area will be stabilized to the satisfaction of the Town Engineer

BE IT FURTHER RESOLVED that the application is consistent with the subdivision Regulations and the F&R-2 zone

BE IT FURTHER RESOLVED that this approval shall  become effective on May 12, 2008.

PUBLIC HEARING (Continued)

APPLICATON BY HATTERTON, LLC FOR A FOUR LOT SUBDIVISION, 22 HATTERTOWN ROAD, NEWTOWN, CONNECTICUT AS SHOWN ON A CERTAIN MAP ENTITLED “FINAL SUBDIVISION MAP PREPARED FOR HATTERTOWN, LLC, NEWTOWN, CONNECTICUT” DATED OCTOBER 22, 2007, SCALE 1”=60’, ASSESSOR’S MAP 8, BLOCK 9, LOT 2 (PARCEL A)

John McCoy, JFM Engineering, 440 Main Street, Ridgefield, Connecticut updated the Commission on the status of the application, noting that the attorney requested an extension, but if still not ready they would withdraw and re-submitted.  Lots had been reconfigured which reduced the open space.  Septic systems needed tweaking.  The drawings had to be revised and would be submitted Monday, May 5, 2008.  Cut and fill calculations needed Town Engineer approval.  The application was continued till May 15, 2008 unless withdrawn.

APPPLICATION BY DAVID W. CLARK FOR A THREE LOT SUBDIVISION, 50 GRET QUARTER ROAD, NEWTOWN, CONNECTICUT, AS SHOWN ON A CERTAIN MAP ENTITLED “SUBDIVISION MAP PREPARED FOR DAVID W. CLARK III, 50 GREAT QUARTER ROAD, NEWTOWN, CONNECTICUT, DATED DECEMBER 28, 2007, SCALE 1”=50’, ASSESSOR’S MAP 56, BLOCK 1, LOT 7

The hearing was opened at 8:25 p.m.

Ms. Brymer read the call for the hearing.

Ms. Dean read the correspondence in the file then asked to hear from the applicant.

Bill Carboni, Spath Bjorklund, 593 Main Street, Monroe, Connecticut submitted proof of mailing and gave a background of the property and explained the application.  The ZBA had waived regulations for driveways to each lot.  The existing driveway will serve all parcels.  All other subdivision regulations had been met.

Ms. Dean asked to hear from the public.

John Karlson, 167 Great Quarter Road, Newtown, Connecticut said that the driveway was too narrow and pointed out an AT&T easement.  He was also concerned about the septic systems.

Kathy Karlson, 167 Great Quarter Road, Newtown, Connecticut wanted confirmation that only one additional house was planned and also noted the narrowness of the driveway.  She was concerned about traffic and tree removal.

Julie Gill, 48 Triangle Street, Danbury, Connecticut asked about the driveway

Mr. Carboni responded saying there are no wetlands on the property.  The AT&T easement was no problem.  He confirmed that they would be only adding one house.  The Health Department approved the septics and the road is considered a country road.  The egress sightlines were within regulations.

The hearing was closed at 8:40 p.m.

ACTION

Ms. Brymer moved the following:

BE IT RESOLVED by the Newtown Planning and Zoning commission that the application by David W. Clark for a three lot subdivision, 50 Great Quarter Road, Newtown, Connecticut, as shown on a certain map entitled “Subdivision Map Prepared for David W. Clark III, 50 Great Quarter Road, Newtown, Connecticut” dated December 28, 2007 and revised 3/28/08, scale 1”=50’, Assessor’s Map 56, Block 1, Lot 7

SHALL BE APPROVED with the following stipulations:

1.      That prior to filing the record maps in the Newtown Land Records:

a.      A bond in the amount of $5,800 shall be submitted to secure the lot pins for the subdivision.

BE IT FURTHER RESOLVED that the application is consistent with the subdivision Regulations and the F&R-2 zone

BE IT FURTHER RESOLVED that this approval shall become effective on May 12, 20008.

CORRESPONDENCE/COMMUNICATIONS

Mr. Benson updated the Commission on the GIS zone map that will ultimately be officially accepted by the Town.

Ms. Dean will distribute a letter to the Selectmen regarding incentive zones.  The Commission discussed how this could be adapted to property in the Fairfield Hills campus.  Ms. Brymer and Mr. Bloom will meet with the Fairfield Hills Authority to explain a possible site.

Mr. Cruson is developing historical data for the GIS database

There was a general discussion on a myriad issues.

Changes to the minutes of April 17, 2008 as follows:

Page 3 – The title of the Public Hearing is:  APPLICATION BY THE TOWN OF NEWTOWN TO MODIFY AQUIFER PROTECTION REGULATIONS AT 2.01.510, 2.01.520 AND 2.01.530

Page 5 – the second item under Correspondence/Communication, the second line should read “…frequently out of town.

The Commission will vote on these minutes at the next meeting.
